Harvey Performance Company, LLC (“we” or “us” or “Harvey”), which includes our Brands (defined below), respects your privacy. Our Brands are Harvey Tool, Helical Solutions, Micro 100, Titan USA, CoreHog,Valor Holemaking, and ATA SGSPRO(collectively our “Brands”).

 

This Privacy Policy does not apply to other data, including data collected offline.

 

We do not share your personal information with those websites and are not responsible for their privacy practices. Once you have left our Online Services, you should check the applicable privacy policy of the third-party websites to determine how they will handle any information they collect from you.

This is collected in aggregate form and use to improve the user experience on the Website, diagnose server problems and administer the Sites, to improve the Services functionality, and for security purposes.

We use website analytics tools such as Google Analytics that retrieve information from your browser such as visit frequency, feature you interact with or use, search terms you enter, links you click on, content you download, and information about how you interact with the Online Services.

To allow us to review the demographics of those who interact with our Sites and information about how the Sites are being used, to improve the visitor experience on our Sites.

To third party analytics companies for purposes of compiling analytic data, and to third party service providers for the purpose of enhancing the Sites.

 

Cookie Policy: “Cookies” are small text files that are placed on your hard disk by a webpage server that allow us to recognize your browser or mobile device and tell us how and when pages and features on our websites are visited and by how many people. You may be able to change the preferences on your browser or mobile device to prevent or limit your computer or device’s acceptance of cookies, but this may limit you from taking advantage of some of our features. You can find out how to do so here: www.aboutcookies.org.  When we collect usage information (such as the numbers and frequency of visitors to the Online Services), we only use this data in an aggregate form, and not in a manner that would identify you personally directly or indirectly.  If you have a Facebook, LinkedIn, or Google+ account, those services may be able to identify that you are on our Sites through the widgets we maintain for each in the header and or footer of most of our Online Services’ pages. This occurs from the cookies that each service places when you use their service.

 

Google Analytics and Pardot: We also use third-party services such as Google Analytics, Google Tag Manager, and Pardot in order to track your activity on our website. The information we collect through these third-party services includes your IP address, your device type and Operating System, your Internet browser, your location, the pages on our Sites you have visited, the actions you’ve performed on these pages. We use such information to better understand your needs and improve our platform accordingly, and also to send you marketing messages that are relevant and match your interests. You can prevent your data from being used by Google Analytics on websites by installing the Google Analytics opt-out browser add-on here.

To opt out of ads on Facebook or Google that are targeted to your interests, use your Facebook or Google Ads settings.

 

Check your mobile device for settings that control ads based on your interactions with the applications on your device. For example, on your iOS device, enable the “Limit Ad Tracking” setting, and on your Android device, enable the “Opt out of Ads Personalization” setting.

 

We may use a plugin called Survicate, which uses cookies to track whether or not you have seen and/or answered a survey pop-up on our Online Services previously. Disabling cookies in your browser will block the Survicate cookie as well, though this may cause you to see the same ad or survey every time you visit a relevant page on the Site.

Please be aware that the e-mail address you provide and any other information you enter while using our Online Services may render you personally identifiable, and may possibly be displayed on this web Sites intentionally (depending on choices you make during the registration process, or depending on the way in which the Online Services ar4e configured) or unintentionally (subsequent to a successful act of intrusion by a third party). As on many web sites, the Online Services’ editor may also automatically receive general information that is contained in server log files, such as your IP address, and anonymous cookie information.

 

About Children

Our Online Services are not intended for children under the age of 16. HOW WE USE YOUR INFORMATION

With the exception of information submitted for employment consideration, personal information you provide through our Online Services is used as set forth above in the summarized chart and for one or more of the following purposes:

To personalize your internet experience with respect to interacting with our Sites and to deliver content and product and service offerings relevant to your interests;

To help maintain the safety, security, and integrity of our Sites, products and services, databases and other technology assets, and business.

To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

We have not sold any personal information in the previous 12 months and do not sell your information.

 

 

 

HOW LONG WE KEEP YOUR PERSONAL INFORMATION

We typically only retain your information for as long as necessary to realize our legitimate business purposes and to comply with the law.

We do not sell, share, or lease your data to third parties for their direct marketing use.  However, we may share your information with people and organizations we trust who need your information in order for us to operate our Online Services or perform other services related to the running of our business and providing out products and services.

You cannot opt out of disclosure of your personal information if required by lawful order.  We do not share the information you provide with third parties for their direct marketing purposes.

HOW WE KEEP YOUR INFORMATION SAFE

Harvey safeguards the personal information you send us and takes reasonable physical, technical, and organizational measures to prevent unauthorized access, unlawful processing, and unauthorized or accidental loss, destruction, or damage to your personal information. We use industry-standard efforts to safeguard the confidentiality of personally identifiable information, including encryption, firewalls and SSL (Secure Sockets Layer).

 

 

 

VISITING OUR SITES FROM OUTSIDE THE UNITED STATES

If you are visiting our Online Services from outside the United States, please be aware that your information will typically be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. Please be assured that we seek to take reasonable steps to ensure that your privacy is protected. The Legal Basis for Using European Personal Information

 

When we collect information about you through our Sites apart from when you apply for employment with us through our Online Services, the legal basis on which we process your personal information is our legitimate interests, namely, to provide you with communications and other information marketing our services.

 

When we collect information about you when you apply for employment with Harvey through our Online Services, the legal basis on which we process your personal information is because it is necessary for the performance of the service you are requesting, namely, for us to consider your candidacy for employment.

 U.S. Privacy Rights

Some U.S. states have privacy laws providing privacy rights to their residents, including the Texas Data Privacy Security Act (TDPSA), California Consumer Privacy Act (CCPA), Nevada SB, Utah Consumer Privacy Act, and Virginia Consumer Data Protection Act. However, these rights are not available to all users located in the U.S.

 

California Privacy Rights

 

California Shine the Light Law: California Civil Code Sections 1798.83-1798.84, permits California residents to request certain information regarding and/or opt-out of our disclosure of personal information to third parties for their direct marketing purposes. We will respond to one request per California customer each year, and we do not respond to requests made by means other than as set forth above.

 

California Minor Content Removal: California residents under the age of 18 you are registered users of our Services may ask us to remove content or information that you have posted to our Services by contacting us. Please note that your request does not ensure complete or comprehensive removal of the content or information, as, for example, some of your content may have been reposted by another user.

 

 

 

California Consumer Privacy Act and the California Privacy Rights Act (collectively the“CCPA”): The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

You can direct us to only use your sensitive personal information (for example, your financial account information, or your precise geolocation data) for limited purposes, such as providing you with the services you requested.

The Right to Know

You have the right to request any or all of the following information relating to the personal information we have collected about you or disclosed in the last 12 months, upon verification of your identity:

  • The specific pieces of personal information we have collected about you;
  • The categories of personal information we have collected about you;
  • The categories of sources of the personal information we have collected about you;
  • The categories of personal information that we have disclosed about you to third parties for a business purpose, and the categories of recipients to whom this information was disclosed;

The Right to Request Deletion

You have the right to request the deletion of personal information that we have collected from you, and to require that the third parties we have shared it with also delete it, subject to certain exceptions in which we are required to retain such information, including compliance with other laws and court orders. We may maintain a confidential record of deletion requests solely for the purpose of preventing the personal information of a consumer who has submitted a deletion request from being sold, for compliance with laws or for other lawful purposes.

The Right to Correct Inaccurate Personal Information

You have the right to request that we correct inaccurate personal information we maintain about you.  Once we receive a verified request to correct your inaccurate personal information, we will use commercially reasonable efforts to correct it.

The Right to Opt-Out of Personal Information Sales and Sharing    

You as a resident of California or Nevada have the right to direct us not to sell or share personal information we have collected about you to third parties now or in the future.

The Right to Non- Discrimination

You have the right not to receive discriminatory treatment for exercising any of the rights described above. However, please note that if the exercise of the rights described above limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you our products or services or engage with you in the same manner.

We will need to verify your identity before processing your request. In order to verify your identity, we may require matching identifying information you provide us to the information we maintain about you in our systems or a successful login to your account (as applicable).

We use good faith efforts to respond to a verify consumer request to know or to delete within forty-five (45) days after its receipt. If we need more time (up to 90 days), we will inform you of the reason and the needed extension period in writing.

You do not need to create an account with us to exercise your privacy rights. However, we may ask you to provide additional personal information so that we can properly identify you in our dataset and to track compliance with your opt-out request. We will only use personal information provided in an opt-out request to review and comply with the request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems and authenticate you as authorized to receive the information.

Authorized Agent

California residents may use an authorized agent to make a CCPA privacy request on the resident’s behalf. To make a request on behalf of a California consumer, the authorized agent must provide a copy of either (a) a letter signed by the consumer authorizing the agent to submit a CCPA request on the consumer's behalf, or (b) a power of attorney, duly authorized and issued pursuant to California Probate law. The authorized agent must email one or both documents to [email protected] and include a phone number where the agent may be reached during regular business hours.

Household Requests

Under the CCPA, members of a California household can jointly request access to personal information for the household or the deletion of all household personal information. To make a household request, each member must first submit an Access or Deletion request [email protected] and request that their Access or Deletion requests be combined with the other members of their household.

We do not currently offer incentives in exchange for the retention, sale, or sharing of personal information.

Your Rights Under Texas Data Privacy and Security Act

If you are a resident of a state that has enacted a State Consumer Privacy Law, then, subject to certain conditions and exclusions, you have the following rights with regard to your personal data:

  • Right to access. You have the right to request access to and obtain a copy of any personal information that we may hold about you.

 

  • Right to correct. You have the right to request that we correct inaccuracies in your personal data. Although Texas law does not grant its residents this right, we grant Texas residents the right to request correction of their data.

 

  • Right to delete. You have the right to request that we delete personal information that we have collected from or obtained about you.

 

  • Right to opt out of the sale of personal information. You may request that we stop disclosing or making available your data in a way that is considered a “sale”.

 

  • Right to opt out of targeted advertising. You may request that we stop disclosures of your personal information for targeted advertising.

 

  • Right to withdraw consent. If you have previously granted us consent to process your sensitive data, you have the right to withdraw consent.

 

  • Right to opt out of profiling. You have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. We do not profile in a manner that would result in legal or similarly significant effects and as such do not offer this right.

 

  • Right to non-discrimination. If you choose to exercise any of the privacy rights described above, we will not deny our products or services to you, charge you different prices or provide a different level or quality of products or services to you unless those differences are related to the value of your personal data.

 

How to Exercise Your Rights Under Texas Data Privacy and Security Act

We will only use personal information that you provide in a request to authenticate the request. We will not further disclose the personal information and will retain it only as necessary for the purpose of authentication and to meet our legal obligations. We cannot fulfill your request if we cannot authenticate it and confirm the personal information that is subject of the request relates to you.

Nevada and Utah Resident Privacy Rights

We do not disclose a user’s personal information to any third party for such third-party’s direct marketing purposes. Nevada S.B. 220 allows Nevada residents to opt-out of the sale of their personal information now in the event we change our Privacy Policy in the future. If you are a Nevada resident we want you to know that, in the event we sell your personal information, you will have choices and can opt out and can affect them by contacting us by email at [email protected]. This may prevent or restrict your use of the Site and/or Service in the future.

 

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

 

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

 

Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

 

Making a verifiable consumer request does not require you to create an account with us.

 

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

 

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time up to 90 days, we will inform you of the reason and extension period in writing.

 

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

 

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

 

DO NOT TRACK DISCLOSURE

Do Not Track is a privacy preference that users can set in their web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user. At this time, we do not respond to Web browser “do not track” settings or signals. We deploy cookies and other technologies on our Service to collect information about you and your browsing activity, even if you have turned on the Do Not Track signal. CONSENT TO RECEIVE ELECTRONIC NOTIFICATIONS

Electronic communication is the most effective and timely way to provide the users of the Sites and our products and services with any optional or required notifications and disclosures. In some circumstances, however, applicable laws may require us to send you disclosures or communications in paper format unless you have affirmatively consented to receiving electronic notifications only in advance of the notification.
